New Hampshire State Court Structure:
The New Hampshire district court has jurisdiction over tort, contract, real property rights ($0/$25,000), small claims ($5,000) and miscellaneous civil matters. The district court has jurisdiction over misdemeanor, DWI/DUI and domestic violence cases. The New Hampshire district court hears traffic and other violations. The district court has exclusive juvenile jurisdiction. The New Hampshire district court has jurisdiction over preliminary hearings. The New Hampshire probate court has jurisdiction over guardianships, trusts, wills, estates, involuntary commitments, and some equity matters. The probate court has jurisdiction over adoption and termination of parental rights. The New Hampshire superior court has jurisdiction over tort, contract, real property rights ($1,500/no maximum), and miscellaneous civil jurisdiction. The superior court has exclusive jurisdiction over marriage dissolution, paternity, support/custody jurisdiction. The superior court has exclusive felony and criminal appeals jurisdiction. The New Hampshire superior court also hears domestic violence matters. The New Hampshire supreme court has no mandatory jurisdiction except for capital murder where the death penalty is imposed. The New Hampshire supreme court has discretionary jurisdiction in civil, noncapital criminal, administrative agency, juvenile, disciplinary, advisory opinions for the state executive and legislature, original proceeding, and interlocutory decision cases.
