Why does this matter for public records searches?

When a city exists outside any county, the usual path — "search the county courthouse" — doesn't apply. Courts, property records, vital records, and criminal history files are held by the city's own agencies, not a county recorder or county clerk. Knowing a city is independent before you search saves hours of misdirected effort.

Explainer

What Exactly Is an Independent City?

A quick primer on how these jurisdictions work — and why they're different from every other U.S. city.

🏛️

Legally Separate from Any County

An independent city is a municipality that is not part of any county. It functions simultaneously as both a city and a county under state law — handling all services (courts, jails, schools, property records) that counties normally provide everywhere else.

📜

A Uniquely American Phenomenon

The concept dates to Virginia's 1871 constitution, which drew a hard line between cities and counties to prevent jurisdictional overlap. The legal tradition spread sparingly to Maryland (Baltimore City, 1851), Missouri (St. Louis, 1876), and Nevada (Carson City, 1969).

🗺️

Virginia Dominates the List

Virginia has 38 of the nation's 41 independent cities — including major urban centers like Virginia Beach, Norfolk, Chesapeake, and Richmond. Each city is its own county-equivalent for all legal and governmental purposes.

🔍

Where to Search Their Records

For independent cities, always go directly to the city's own clerk, circuit court, or records office — not the surrounding county. The city maintains all deed books, court dockets, marriage licenses, death certificates, and criminal history files independently.

🗺️ How Virginia Records Work

Each Virginia independent city operates its own Circuit Court (civil and criminal records), General District Court (misdemeanors, traffic), Commissioner of the Revenue (property assessment), and Clerk of Circuit Court (deeds, wills, UCC filings). The surrounding county has zero jurisdiction within city limits.

The Other 3 Independent Cities

Outside Virginia, only three other American cities exist entirely independent of county government.

Baltimore, Maryland
Independent City since 1851
Pop. ~585,000. Separated from Baltimore County in 1851 — one of the oldest independent city designations in the U.S. All records (deeds, courts, vital records) are held by Baltimore City agencies, not Baltimore County. The two are entirely separate jurisdictions despite sharing a name.
St. Louis, Missouri
Independent City since 1876
Pop. ~300,000. Separated from St. Louis County by the Missouri constitution of 1876. Today the city and county are entirely separate governments sharing a metro area. The St. Louis City Circuit Court (22nd Judicial Circuit) holds all criminal and civil records for city residents.
Carson City, Nevada
Independent City since 1969
Pop. ~58,000. Nevada's state capital became the nation's most recent independent city in 1969 when it merged with Ormsby County (which was abolished). Carson City is now a consolidated city-county — the only one in Nevada. All records are held by Carson City government offices.

Frequently Asked Questions

Everything you need to know about independent cities and their public records.

Contact the Virginia Beach Circuit Court directly — not any Virginia county court. Virginia Beach is an independent city, so it operates its own 2nd Judicial Circuit. You can search online at the Virginia Judiciary's case information system (va.courts.gov) or visit the courthouse at 2425 Nimmo Pkwy, Virginia Beach, VA 23456.
No — and this is one of the most common public records mistakes. Baltimore City and Baltimore County are completely separate jurisdictions that happen to share a name. They have different governments, different courts, different property records systems, and different vital records offices. A deed recorded in Baltimore County will not appear in Baltimore City records, and vice versa. Always confirm which jurisdiction you need before searching.
Go directly to the city's Commissioner of the Revenue (Virginia) or equivalent city assessor office. In Virginia, the Clerk of the Circuit Court also maintains deed books and land records. For Baltimore, use the Maryland State Archives MDLANDREC system. For St. Louis, use the St. Louis City Recorder of Deeds. For Carson City, use the Carson City Assessor's Office.
Virginia's 1871 state constitution created a legal framework separating city and county governments to prevent taxation disputes. As cities grew, they could formally detach from surrounding counties through a legal process. Over time, 38 cities exercised this right. The system persists today, though no new independent cities have been created in Virginia since Manassas Park in 1975 — and several smaller ones have discussed reversion to town status.
Vital records in Virginia are held by the Virginia Department of Health's Office of Vital Records statewide, regardless of independent city status. You can order online at vdh.virginia.gov/vital-records or in person at the regional vital records office. Local registration is handled by the city's own registrar, but certified copies are issued through the state office.
Yes — the concept exists globally. Germany has three Stadtstaaten (city-states): Berlin, Hamburg, and Bremen. The UK has several cities with county status (e.g., London). South Korea has special cities (Seoul, Busan). However, the American independent city is a uniquely specific legal category defined by state constitutions — it's not directly comparable to these international examples.
