What South Carolina inmate records show, and what stays private

The South Carolina Freedom of Information Act, S.C. Code section 30-4-10 and following, makes the custody record public, and the SCDC posts photographs, offenses, sentences and release dates. Detention centers publish booking photos, though South Carolina law bars websites from charging for their removal. Medical and mental health records, the pre-sentence investigation, classification and disciplinary files and parole case files are exempt. The State Law Enforcement Division sells a name based criminal record check called CATCH to anyone online for a fee, and county clerks of court post public case indexes.

Parole, probation and release in South Carolina

The Department of Probation, Parole and Pardon Services is a separate agency from the prison system. Its Parole Board hears eligible prisoners after a quarter or a third of the sentence depending on the offense, and its agents supervise parolees and probationers from offices in every county, which is why supervision cases are not in the SCDC search. South Carolina requires 85 percent of the sentence for no parole offenses. The judgment sits with the clerk of court of the county of general sessions where the case was heard.

Guide

When the search shows nothing

If the SCDC search returns nothing, check the detention center search for the county of arrest, starting with Richland, Greenville, Charleston, Spartanburg or Horry, since pending cases and sentences of up to a year stay in the county. A probationer or parolee is supervised by the Department of Probation, Parole and Pardon Services. Check the county clerk's public index for the case, the federal Bureau of Prisons locator for a federal case, including the federal prisons in Edgefield, Estill and Bennettsville, and VINELink for a recent release.

Federal & National Authoritative Sources

These federal and national sources complement South Carolina's state-level records. They are the authoritative sources you should cross-check when South Carolina state records are incomplete or out-of-state activity matters.

Federal BOP, Inmate Locator The Federal Bureau of Prisons locator returns federal inmates held since 1982 in any BOP facility, contract facility, or community corrections center.

VINELink, Victim Notification Operated by Appriss for the U.S. Department of Justice's victim-notification program. Free, anonymous registration for custody-change alerts across participating states.

U.S. Marshals, Prisoner Tracking The USMS Prisoner Tracking System is the authoritative source for federal detainees in pre-trial custody (before BOP designation).
