North Dakota holds state prisoners under the Department of Corrections and Rehabilitation at the North Dakota State Penitentiary and the Missouri River Correctional Center in Bismarck, the James River Correctional Center in Jamestown and the Dakota Women's Correctional and Rehabilitation Center in New England, with transition centers in Bismarck, Fargo, Grand Forks and Mandan. County jails and regional correctional centers run by the 53 sheriffs hold pretrial detainees and sentences of up to a year, and the Cass County Jail in Fargo and the Burleigh Morton Detention Center in Bismarck are the largest.

The North Dakota DOCR lookup runs on the name or the DOCR number and returns the number, name, date of birth, the facility or the supervising parole and probation office, the status, the projected release date and each offense with the county and sentence. The Department calls people in its custody residents. Because the Division of Parole and Probation belongs to the Department, supervision cases appear in the same search.

The Cass County Jail in Fargo posts an inmate roster with booking dates, charges and bond, as do the Burleigh Morton Detention Center in Bismarck, the Grand Forks County Correctional Center, the Ward County Jail in Minot, the Stutsman County Correctional Center in Jamestown, the Williams County Correctional Center in Williston and the Barnes County Correctional Facility in Valley City, which also hold prisoners for neighboring counties under regional agreements. Fargo Police, Bismarck Police and the North Dakota Highway Patrol book into the county jail of the arrest.

North Dakota's open records law, N.D.C.C. section 44-04-18, and the state constitution make the custody record public: name, DOCR number, facility, status, offenses and release date. The Department does not post photographs. Sheriffs release booking information and most post booking photos. Medical and mental health records, the pre-sentence investigation, classification and disciplinary files and Parole Board case files are exempt. The Bureau of Criminal Investigation sells a name based criminal history to the public for a fee, and the North Dakota courts' public search lists criminal cases statewide.

The North Dakota Parole Board hears eligible residents and posts its hearing schedule and decisions, and the Division of Parole and Probation supervises parolees and probationers from offices in Bismarck, Fargo, Grand Forks, Minot, Jamestown, Dickinson, Williston and Devils Lake. North Dakota's Free Through Recovery program pairs supervision with community treatment providers for many releases. The judgment sits with the clerk of the district court of the convicting county.
