County Clerk records are different from Circuit Clerk files

Wyoming County's County Clerk records land instruments, vital events and wills, handles probate functions and maintains election records. The Circuit Clerk keeps Circuit and Family Court case records. Identify the document before asking for a generic county record: a deed, divorce order and estate record can involve different series even when the same family appears in each.

For an estate investigation, write down the decedent's full name, approximate date of death and any known estate reference. For a divorce or custody order, use the case number and identify the order needed. The custodian can determine whether access is public or restricted; a name appearing in a search does not establish access to every attachment in the case.

Court type determines the contact and location

The judiciary's Wyoming County directory places Wyoming in the Twelfth Judicial Circuit with McDowell County and in the Thirteenth Family Court Circuit with Raleigh and Summers counties. These are district designations, not the number of courthouses in Wyoming County. Use the directory's Wyoming contact for the particular court instead of selecting another county merely because it shares the circuit. The directory lists the Circuit Clerk at 24 Main Avenue in Pineville and the Magistrate Clerk at 44 Cedar Street. A court hearing notice can specify a different destination from the records counter, so retain both the court name and the purpose of the visit. An appeal from a magistrate case can create a related Circuit Court file without replacing the underlying magistrate record.

A magistrate result identifies a file, not its document images

The Magistrate Record Search instructions explain that the public system returns case information while the actual court documents must be requested from the county magistrate clerk. Narrow a search with the case number or identifying information available to you. Save the county and case reference along with the listed disposition.

The judiciary's public resources directory separately provides circuit-court search access and describes registered-user document downloads. Do not assume that magistrate search, circuit search and family-case access have identical coverage or download rules. If a document is unavailable remotely, request the specific filing from its custodian and ask whether the issue is access, digitization or identification.

Trace the deed independently of the tax map

Recorded land instruments belong with the County Clerk. Follow the grantor and grantee names and preserve the recording reference, legal description and related plat references. When an instrument conveys only part of a tract, a current parcel number may not describe the entire historical holding. Record what each document actually conveys before combining it with the current assessment.

The Assessor's instructions explicitly distinguish tax maps from survey maps. Use a tax map to identify an assessment parcel and ask for the relevant property record, but do not present it as a surveyed boundary determination. A field description in an assessment file may help locate property without resolving every recorded easement or ownership interest.

The sheriff also has a tax-collection function

The Sheriff's Tax Office describes the sheriff's separate role as county treasurer and provides the route for tax records and payments. Include the account, parcel and tax period in a request for billing or payment history. A valuation question belongs with the Assessor, while an error in the posting of a payment should identify the receipt and the collection account.

A tax record can show how an account was billed or paid without proving who owns every interest in the land. Compare it with the recorded deed where ownership is the research question. Keep delinquency notices and later payment records in date order so an old balance is not mistaken for the current amount.

County policing and regional detention use separate contacts

The Wyoming County Sheriff provides local law-enforcement and court-security services. The state's Southern Regional Jail and Correctional Facility identifies Wyoming among the counties it serves and lists its facility at 1200 Airport Road, Beaver, WV 25813. The courthouse switchboard is not the facility's published detention contact.

Use the investigating agency for an incident report, the holding facility for custody information and the court clerk for the judicial outcome. When following a transfer, check the current facility rather than reusing an earlier booking location. An arrest allegation and a final disposition should be reported as separate events, with the source and date kept beside each.

A research record and a certified certificate serve different purposes

The County Clerk describes local birth, death and marriage holdings for historical research. Identify the person, event and approximate date before requesting a search. Ask whether the available record is the original county entry, an index or a certified copy. An index may point to an entry without carrying every detail on the underlying record.

The state Vital Registration instructions provide another route for eligible certificate requests. They list $12 per copy for the state service and identify the application, identification and payment requirements. This is a state-office price, not a verified quote for every county-clerk copy product. For a divorce decree, return to the court custodian instead of ordering a birth, death or marriage certificate.

Commission decisions and development questions

The County Commission is a starting point for identifying county administrative records and the responsible department. Describe the agreement, meeting action or other existing document sought. For a development inquiry, identify whether the site is in a municipality and what approval was issued before naming a supposed county permit custodian. Ask commission staff which department administered the approval and where its completed file is retained.

Under West Virginia Code section 29B-1-3, a records custodian must act as soon as practicable and within 5 days excluding weekends and legal holidays. The response can supply copies, arrange inspection or deny access with written reasons. The provision permits actual reproduction costs but excludes search or retrieval charges.
