Are county records public information?

Yes. Oregon's Public Records Law, ORS 192.311 and following, requires a public body to acknowledge a request within five business days and complete it as soon as practicable, generally within 10 business days. Court records, county clerk recordings and assessor data are open. Oregon birth records are confidential for 100 years and death records for 50 years, after which the State Archives provides copies; newer certificates go to the person named, family and legal representatives. Juvenile and sealed court files are closed.

How much do certified copies cost?

A certified Oregon birth, death, marriage or divorce certificate costs $25 from the Center for Health Statistics, which covers a five-year search and the first copy, with additional copies $25 each; VitalChek orders add a $7 expedite fee and a $15.50 vendor and ID verification fee, for a total of $47.50 for the first certificate, and UPS next day air is $20. Full-image birth certificates from 1903 through 2007 are $30. Lane County sells certified marriage copies for $7.75, and public bodies must give a written estimate before charging more than $25 for records.

Can I search county records online?

The Oregon Judicial Department's Records and Calendar Search gives free online access to basic case information and calendars for circuit courts, the Tax Court and the appellate courts, and OJCIN OnLine is a subscription service with fuller records. County clerks record deeds and easements, with online indexes in counties such as Douglas and Jackson, and assessors post parcel data. The Oregon State Police accepts open record requests for another person's Oregon criminal history, and vital records are ordered from the state, a county health department or VitalChek, not searched.

What identification do I need?

Open records need no ID. Oregon vital records orders require a signed order form, a copy of the applicant's identification and proof of eligibility, and VitalChek screens applicant identity for online, phone and in-person orders. Eligible applicants include the registrant, parents, children, siblings, spouses, grandparents and legal representatives.

How long does it take to receive records?

County health departments issue birth and death certificates for events within the past six months, often the same day. Orders to the Center for Health Statistics are processed after the five-year search, and amendment processing times are posted on its site; VitalChek orders with next day air arrive fastest. Court and county clerk searches are immediate.
