About Arkansas Public Records

Arkansas's open-records framework is the Arkansas Freedom of Information Act, codified at Ark. Code Ann. § 25-19-101 et seq. The FOIA is considered one of the stronger state sunshine laws in the country. It presumes that all records in the possession of public officials are open to any citizen of the state, and generally requires a response within three business days.

Exemptions include juvenile court records, sealed or expunged criminal records, medical records, some personnel records, undercover investigation files and some taxpayer information. A 2023 amendment closed some more state agency records.

Court Records

Arkansas's trial courts are the circuit courts (felonies, larger civil cases, probate, domestic relations and juvenile cases) and the district courts (misdemeanors, smaller civil cases, small claims and traffic). Appeals go to the Court of Appeals and the Supreme Court. CourtConnect, linked in Where to Look, shows circuit and district court dockets free.

Vital Records

Arkansas vital records are kept by the Arkansas Department of Health. Birth certificates are limited to eligible requesters for 100 years and death records for 50 years. Marriage records are kept by the county clerk where the license was issued, and copies also go to the state.

County & City Resources

Arkansas has 75 counties. The largest are Pulaski (Little Rock), Benton (Bentonville and Rogers), Washington (Fayetteville), Sebastian (Fort Smith), Faulkner (Conway), Saline (Benton and Bryant), Craighead (Jonesboro), Garland (Hot Springs), Lonoke and White. Some counties have two county seats (Sebastian has Fort Smith and Greenwood; Arkansas County has DeWitt and Stuttgart), so confirm which courthouse holds the record. For every county, see our Arkansas County Public Records index.

People Search Tips for Arkansas

Start with CourtConnect, it's free, statewide, and covers both Circuit and District courts.

The circuit clerk keeps civil, criminal, probate and property records, so one office often answers several questions.

Check dual county seats, a handful of Arkansas counties have two county seats, and records may be split between them.

Assessor and Clerk are separate, for full property research, consult both the Circuit Clerk (deed) and the County Assessor (valuation).

Researcher Tip: CourtConnect can miss cases when you search a last name alone. Add a first name or initial, try common alternates (Michael and Mike, Robert and Bob), and search maiden names for married subjects.
