Are county records public information?

Yes. The Minnesota Government Data Practices Act, Chapter 13, makes government data public unless a statute classifies it otherwise, and court records are governed by the Rules of Public Access. Court cases, recorded land documents and property tax data are open, and all Minnesota death records are public. Birth records are public unless marked confidential, but only eligible people can get certified copies; juvenile and sealed court files are closed.

How much do certified copies cost?

A certified Minnesota birth certificate costs $26 and a certified death certificate $13 from any vital records office, and a noncertified informational birth record is $13; county marriage certificates are $9. Homeless people age 24 or younger born in Minnesota and Veterans Administration applicants can get birth certificates free. Public criminal history searches on the BCA site are free, and under the Data Practices Act copies of 100 or fewer pages cost 25 cents a page.

Can I search county records online?

Minnesota Court Records Online, MCRO, gives free public access to district court case records and many documents, with the most complete access at courthouse terminals. County recorders and registrars of titles keep deeds and mortgages under the Abstract and Torrens systems, and most counties offer online land record search along with property tax data. The BCA's Minnesota Public Criminal History site is free, and vital records are ordered from a county office or the Department of Health, not searched, though the Minnesota Historical Society indexes births from 1900 to 1934 and deaths from 1904 to 2001.

What identification do I need?

Open records need no ID. Minnesota requires certified birth and death certificate applicants to present identification and sign in front of county staff when ordering in person, or to have the application notarized when ordering by mail; only eligible people, such as the person named, parents, children, spouses and legal representatives, can get certified copies. Noncertified informational copies of public records need no eligibility.

How long does it take to receive records?

County vital records offices are the fastest option; most issue certificates while you wait, while orders to the Department of Health take longer. MCRO case searches and public criminal history lookups are immediate.
